SHOPPING TERMS AND CONDITIONS

ROSAS DEL AGAVANZAL is a florit shop business operative located in Madrid (Spain) at 110 Vallehermoso street, 28003 Madrid, which makes flower/plants arrngements and delivers them  in Madrid and surrounding towns and operative in the rest of Spain through other partner florists.

We are only Happy if You are Happy! We know how much it means to send Flowers and Gifts to a loved one. We understand the importance of On-Time delivery, Fresh Flowers and the happiness that they will bring. We know that each product we deliver is a special message from you to someone. By appliyng the highest quality conditions in our local products or our shops in Spain , each with their own exclusive area, we are able to carefully control and distribute your orders with love and care, ensuring that the flowers and gifts always look their best. If for any reason you or the recipient is not happy please contact us via our customer service web page and use your order number via the message system for faster and more efficient service. The 100% Satisfaction guarantee is subject to the following conditions: Delivery address: You must complete all the address fields when entering your order, including the recipient phone number. Wrong addresses could mean the impossibility of the required time for delivery and the order should go back to the local florist. In this case a new delivery  means an increase of at least 10,00 euros in the budget unless recipient picks up the gift at the local florist. So, please avoid using addresses where you believe the recipient to be absent most of the day, or at least give us telephone numbers if you are not absolutely sure of the presence of your recipients in the time required.  Delivery times: ROSAS DEL AGAVANZAL offers same-day delivery on our “Flowers Collection” placed before the “Cut-Off Time”, as allowed in the order process. In most cases we do not deliver on Sundays. Delivery times for cities and towns different of Madrid and outskirts could need 24 - 48 hours delay or an increasement in the budgets,  specially in the articles indicated an exclusive delivery in Madrid and outskirts. Cut off times are indicated in the order process. Special occasions and local holidays: We will always accept your orders, and in most cases be able to process them on time. However, we cannot guarantee last minute orders for special occasions, and we will make the delivery at the earliest possible date. For special occasions we could be unable to guarantee morning or afternoon delivery.   Local Holidays & Bank Holidays: Please see if delivery is possible in our website. There ara some few local or national Holidays in Spain in which our services are closed. If the delivery date coincides with a local holiday in the destination, and the local florist is closed, the order will be automatically sent at the earliest opportunity when the holiday has ended. You may receive a disclaimer message to this effect when placing the order. If you believe that any of the above could apply to you then it is advisable to allow extra time for such situations when placing your order. Products and images: Products only contain the items listed in the product description, and may be different of the pictures described. We can only guarantee the closest similitude to pictures in products for our direct delivery areas: Madrid city and towns under 20 kms far from downtown. for the rest of Spain, will dbe send an aproach to the item in the picture depending on local prices, distance of delivery and time between shopping and delivery. ROSAS DEL AGAVANZAL delivers complements from other shops such us chocolates, biscuits, ckes fruits and low graduation alcoholic drinks (wines and sparkling wines). In this last items, due to the Spanish laws, its forbiden to sell alcoholic drinks to person under 18 years old. ROSAS DEL AGAVANZAL will ask for age verification to recipients and will not deliver this articles if they are below 18. Item will be refunden before 48 hours to client. in case of combinated baskets, the whole order will be refunded except for the delivery costs generated. Vases and other items are not included unless stated in the product description and are only used for display purposes. Product photos of Flower Bouquets always represent a close approching of what the recipient get due to products available and seasonal posibilities. By ordering some days before the delivery you would easily receive the most close image to the photos. Product photos are a representation of the arrangements and may vary (see Substitution Policy below). Substitution policy Roses will never be substituted by other flowers or floral products without requesting your confirmation first. Flower arrangements are unique and handmade, so no two are ever identical. Every effort is made to fulfil your order as closely as possible to the product photos and descriptions. In some cases, local florists may not have some items in stock and careful substitutions of equal or greater value will automatically be made. We will always maintain the value and concept of the chosen product. If an added product is not in stock with the local florist we will add the money paid for the item to the value of the flowers and create a bigger bouquet. Scheduling deliveries can guarantee flower delivery on a specific day up to 2 months in advance. We cannot guarantee a specific delivery time during the day. On some occasions, the recipient may be called to ensure delivery on the date requested. Currency Orders will always be charged in Euros.   ROSAS DEL AGAVANZAL cannot be held responsible for any currency conversion differences, and / or charges made by your bank. For accurate pricing please refer to the Euro currency option. Hospitals, hotels and company deliveries: Orders to hospitals, hotels or companies addresses are  guaranteed due to the presence of the recipients in this places at the time requierd, and if flowers are rejected, a new delivery would be made only by adding at least  10,00 more euros to the budget, or the order should be picked at the florists or the shipping company stores. Please indicate the name and telephone number of the hospital, hotel or company. In the case of hospitals we also need the recipient’s ward and room number. ROSAS DEL AGAVANZAL will send your bouquet in accordance with the facilities procedures, and cannot be held liable if these procedures prevent successfull delivery, but our local florist will always attempt to do so. You should note that many hospitals do not permit florists to deliver bouquets personally to individual rooms, and that most ICUs do not permit flowers. ROSAS DEL AGAVANZAL cannot issue refunds if the delivery failed due to any of the above. Cancellation policy In the case that you want to cancel an order, you will be given a full refund if you have given us a minimum of 2 days notice before the delivery date. If notice of cancelation arrives less than 2 days before the delivery date you will only be given a refund of 50%. If notice is given less than 24 hours before the delivery date no refund will be given. Please note that all refunds will be made minus any taxes, charges or currency conversions incurred by  Rosas el Agavanzal during the transaction. In the case of Gift baskets see the Gift Baskets section at the bottom of this document. Duplicated order: If you placed 2 or more identical orders you can receive a full refund for the duplicated order, after being asked about if you want to place buy just one item or two, If there´s no response from client 24 hours before delivery, we will join up the two ordes in one to make them double. If the local florist does deliver the order initially placed, we cannot give any refund. ROSAS DEL AGAVANZAL cannot be held responsible for duplicated orders. Changes in order details You may change the order details by sending us an ´-mail to agaganzal1@orange.es, but this may change the price or availability of the articles required, specially when another town of delivery is required. Change in order details are only guaranteed if made 2 days before the delivery date. If you have given the wrong delivery information we cannot offer guaranteed delivery. In most cases you will be given the opportunity to adjust the information before the delivery date. If the florist reports to us that the delivery address is incorrect we will attempt to contact you and acquire new information, but we are not responsible if we cannot contact you. In some cases we will be able to deliver to a new address free of charge, but this depends on the location of the new address and the expenses incurred by the local florist. In certain cases there may be extra charges. Price increase request In some rare cases we may be forced to contact you and request a price increase to successfully deliver the flowers. Working with local florists is a huge advantage with quality and timing; however, it does mean that on rare occasions our local florist may be subject to certain restrictions: If the delivery address of the order is a remote place and the florist needs an extra fee for the long distance. If certain items are out of stock or market prices have suddenly risen, due to local seasonal changes. If for special events or occasions the market prices have risen over and above our advertised supplement. If for any other reason there is a need for more money to process the order successfully. In all cases we will attempt to contact you and confirm if you wish to add the requested price increase to the order or cancel the order. If the order is canceled you will receive a full refund. Invalid credit card details If you provide us with incorrect or invalid credit card or payment details we cannot process your order. We will attempt to contact you to correct these details, but in all cases you are fully responsible for any issues that arise from providing such incorrect details. Exceptions ROSAS DEL AGAVANZAL is not responsible for: Flowers, plants and preserved items delivered to incorrect addresses supplied by the sender. Unsuccessful deliveries arising from the recipient not being present at time of delivery at the address supplied by the sender. Decreased flower and plant quality due to an incorrect delivery address supplied by the sender, or a re-route requested by the sender. Flower and plant quality problems, where delivery is delayed due to sender requiring signature upon delivery. Complaints Any possible complaint should always be accompanied with your order number, sender information, recipient information and digital photos clearly showing the product and time of delivery. All complaints must be made as soon as possible after the delivery date, and up to a maximum of 24 hours after the delivery. This is very important to allow us to investigate the complaint correctly with the local florists. After this date complaints cannot be investigated.  RESPONSIBILITIES: ROSAS DEL AGAVANZAL is not responsible for failed deliveries when (1) the customer provides an incorrect or outdated address, (2) the gift recipient is on vacation or not home on repeated (2 minimum) delivery attempts, or (3) the customer does not promptly (24 hours) provide a corrected/new delivery address. If the transportation company is forced to return a gift to us after 2 delivery attempts for any of the above reasons, the customer will be charged - if required- for the shipping and handling  expenses due to the shipping companies requirements or local florists expenses. ROSAS DEL AGAVANZAL will however resend your gift to a new address at the customer's request, if the customer agrees to pay the shipping and handling charge which is a minimum amount of 10,00 EUROS. CUSTOMS & DUTIES GUIDELINES ROSAS DEL AGAVANZAL does not send through shippings which require Customs inspections.  For food, ROSAS DEL AGAVANZAL recommend that people with allergies, diabetes, or any other health problem always read and follow the instructions on the labelling.Changes and refunds: ROSAS DEL AGAVANZAL does not admit any refund due to an order properly deliverd due to insatisfaction of recipient/client, under any circumstance. You can visit our local flower shop and ask for a change of an article of the same price, or to change aspects of the arrangement if this make it better for you. This must be done before the next 24 hours after delivery. After this time, no change would be allowed. If there´s no possibility for client/recipient to visit the florist we could delay this visit for 24-48 more hours if previously you have send us a clear picture which shows the matter of dissapointment. If you are absolutely unable to visit the florist, we would refund the 50% of the budget.Changes and refunds are decission of the florist who made thre initial arrangement. Small defects on flowers and plants, the status of the opennig if the buds, changes in the disposal of the elements or other personal matters argued by clients/recipients are no enough matter for local florist to accept changing the article, specially if this means cast away the initial arrangement.
